CUSTOMER ASSISTANCE SALES CONDITIONS - GENERAL CONDITIONS OF SALE

ARTICLE 1. SALE

The website Quattro Gatti Rooms & Suite (hereinafter the "Website") is an e-commerce website accessible via Internet at the Url www.quattrogatti.co. The Website can be used by all parties connected to the Internet system (hereinafter the "Users").

The Website is owned by Quattro Gatti S.N.C. (hereinafter the "Quattro Gatti") based in Via Don Giavazzi, 13 - 24049 Verdello, BG – Italy.

Quattro Gatti through the Website it is authorized to sell its products, including rooms in accommodation facilities (hereinafter the "Products") to the Users who will visit the Website. The MyPos company www.mypos.eu is in charge of online payments.

 

As part of these General Terms and Conditions of Sale (hereinafter the “GCS”), with the term "Parties" they will be indicated jointly Users and Quattro Gatti and with the term "Part" one of the two separately. The term "Buyer" will indicate all Users who have placed an order for the purchase of Products. To the Buyer will be referred to and the same rights will apply and obligations under the GCS for Users.

 

The sale of the Products through the Website is intended solely for the personal use of Users, and not for the purpose of their professional activity. To this end, Users acknowledge that the value of their order cannot exceed the sum of € 1.000,00 (one thousand), and that they can order, within a single order and in the same month, a maximum of three (3) Products at the same facility. In the event that the order entered exceeds the aforementioned value and/or amount, the same will be considered invalid.

 

Users who wish to purchase on the Website, aware of civil and criminal liability in case of false declarations, they declare to be adults for the purposes of Italian law (18 years).

 

Each purchase order of Products offered on the Website implies consultation and express acceptance of the GCS, without, however, such acceptance being conditional upon a signature by the User. According to the articles 1321, 1322, 1326, 1335 of the Italian Civil Code, on D.Lgs. n. 21/2014, on D.Lgs. n. 185/99, implementation of the directive 97/7/CE, and at D.P.R. 513/97, filling in and sending the order form, of which to the following art. 4 "How to enter and confirm orders", constitutes for all legal purposes a contract of sale between Quattro Gatti and the Website User, from which arise mutual rights and obligations governed by civil law.

 

The User can save and print the GCS, provided that no changes are made to them.

 

The GCS define all the necessary steps in order to carry out an order, as described in the paragraph 4 "How to enter and confirm orders" and ensure the execution of the aforementioned order between the Parties.

Quattro Gatti can update the GCS at any time.

These GCS will apply to the exclusion of any other document.


 

 

ARTICLE 2. PRODUCTS

Products that Quattro Gatti sells are those listed on the Website, and at the date on which the Users consult the Website, within the limits of availability of rooms and facilities and subject to the conditions established in Paragraph 1. The photographs illustrating the Products do not fall within the present contractual framework; therefore Quattro Gatti cannot be held responsible for any errors and/or dissimilarity. Despite the commitment to ensure a faithful reproduction of the environments of the Products represented in the photos published on the website www.quattrogatti.co compared to the original ones, hypotheses of non-compliance are not excluded, in particular due to technical limitations in the computer reproduction of colors. Consequently, Quattro Gatti cannot be held responsible for errors and/or inaccuracies in the graphic and photographic reproduction of the environments present on the website www.quattrogatti.co.
Product Availability
Products are offered within the limits of available stock. In the event of unavailability of a Product, the User will be informed as soon as possible. The aforementioned communication may be provided to the User: - At the same time as the order request: A window will appear informing the user that the product selected is not currently available.

Users will be able to enter their e-mail address in order to be informed as soon as the Product becomes available again.

ARTICLE 3. PRICES AND PAYMENT METHODS

Price
Product prices are shown in Euros and include VAT. The price charged to the Buyer is the price set in the order confirmation sent by e-mail from Quattro Gatti. The set price does not include delivery costs, which will be invoiced separately and specified to the User before the order is confirmed and at the time of confirmation and final validation. The OAPLF reserves the right to change the prices published on the Website at any time, anyhow, the Products, subject to availability, will be billed based on the rates indicated at the time of order registration. The current rate will be the one indicated on the Website, except for the case of typography error.

Payments
All payments must be made immediately via the Internet. Subject to server availability, the User will be able to make the payment in the following ways: Credit card, PayPal and Bank transfer.

Credit card (Visa, Mastercard). The Buyer will have to enter his/her credit card number, the expiry date, the name of the card holder as reported on the same and the 3 last three numbers of the security code on the back of the card. In the fight against Internet fraud, banking operations and any other information relating to payment and orders will be controlled and conducted in extreme safety through the BIBIT Internet Payment banking group designated by Quattro Gatti as the party responsible for payments. Quattro Gatti reserves the right to refuse all orders or deliveries in the following cases: if the limits established in art.1 are exceeded, if there is any dispute with the Buyer, in case of total or partial non-payment by the Buyer of a previous order, if a request for payment by credit card is rejected by the bank to which it belongs, or in the case of total or partial non-payment.

 

ARTICLE 4. CONDITIONS OF ENTRY AND CONFIRMATION ORDER

Navigation within the Website
Users can view and choose the various products marketed by Quattro Gatti to the following address: www.quattrogatti.co. Users can consult the various pages of the Website free of charge, without any obligation to purchase.

Registering an order
If a User wishes to enter a reservation, he/she must choose the various Products of his/her interest by clicking on the "Booking" button.

The User must identify him/herself: by entering the name, their email and telephone number. If the User chooses to pay by credit card, will have to confirm the choice by clicking on "Credit card". The User must then enter the details of his/her credit card, as requested in the page. The related orders will be validated after the credit card details have been entered on the secure page of the bank designated by Quattro Gatti: the myPOS system for Internet Payment.

CONFIRMATION OF A RESERVATION

Once the Buyer has validated to his/her reservation and provision for the relative payment, a summary window will appear showing the transaction number. This confirmation will be sent to the Buyer also in the order confirmation sent by e-mail. The aforementioned confirmation will include all the constituent elements of the contract established between the Parties including the goods requested, payment arrangements, delivery instructions and information regarding the right of the Buyer to cancel an order, as well as the address of the Quattro Gatti headquarters to which you can send any complaints. It is advisable in any case to keep a copy (electronic or paper) of information concerning the order. When the order is ready and has been sent, an email confirming shipment will be sent to the Buyer. The data recorded and collected on the Website constitute full proof of all transactions concluded between the buyer and Quattro Gatti. In the event of a dispute between Quattro Gatti and the Buyer regarding a transaction executed on the Website the data recorded by Quattro Gatti will constitute full proof of the contents and the transaction.

ARTICLE 5. RIGHT OF WITHDRAWAL

The right of withdrawal can only be exercised by the Buyer and not by third parties.

In the event that the Buyer claims the non-recognition of the right of withdrawal by Quattro Gatti, for failure to receive the notice of withdrawal, it will be the Buyer's evidentiary duty to prove that he/she has fulfilled it.

The right of withdrawal can only take place if the service has not yet been rendered or if there are less than 3 days before the start of your stay (Cancellation Policy).


 

 

ARTICLE 8. MAJOR FORCE

None of the Parties will be responsible for the total or partial breach o for the delay in the execution of its obligations under this contract that are caused by an event that cannot be prevented (Major force).

Major Force events may include, by way of example only, wars, riots, insurrections, serious Internet security problem, technical failures, unauthorized access and/or intrusions on the website servers, strikes of any form, telematic or telephone failures.

If a Part assumes that a force majeure event has occurred, must inform the other Part within 5 working days by the occurrence of the event or the risk of the occurrence of such occurrence.

The Parties agree to meet in order to jointly determine the terms and conditions for the compilation of orders during the presence of a Force Majeure event.

After one (1) month of interruption due to a Force Majeure event, Quattro Gatti may elect to cancel the order and refund the Purchaser, where due.

ARTICLE 9. PARTIAL INVALIDITY

If one or more clauses of the GCS will be considered invalid or it will be declared as such pursuant to the law, regulation or by virtue of a final judgment, all other clauses will remain fully valid.

ARTICLE 10. CONTRACT

These GCS and the entire summary sent to the Buyer form an integral part of the contractual relationships between the Parties.

 

In the event of discrepancy between the aforementioned documents, the GCS will prevail.

ARTICLE 11. APPLICABLE LAW - COMPETENT JURISDICTIONS

The GCS and the contractual relationships between Quattro Gatti and the Purchaser are governed by Italian legislation. Any action or claim relating to the use of the site will be the responsibility of the Italian courts and tribunals.

ARTICLE 12. COMPLAINTS

For any and all claims regarding the order made, purchase made and/or products purchased, the Buyer may contact the customer service for which references are given:
